Don made an open records request to DA Lipske for a copy of the Pre-Parole Hearing form sent to him by the DOC that was to be mailed back to them with his opinion on whether or not he opposed Don's release. After his first 2 requests were ignored by Lipske, Lipske finally faxed the prison with the above letter after Don's third request for this information.
Apparently, the cover letter on the fax had a note that said that the prison must not have received an earlier fax from the 11th of July. Note the letter is dated July 11th, but, faxed on the 22nd. He implied that this was the letter he originally faxed the prison for Don on the 11th.
Now note the last paragraph of this letter,
"My intentions were to send a copy of the stipulation in which I agreed to your release. However, between the time that I received the form and the due date, I received another letter through the actions of your parents challenging my license to practice law. Therefore, nothing was sent as I intended."

This is typical Lipske and typical Iron County. Now, nearly every open records request to anyone at 300 Taconite St. is fraught with silly games but, this one takes the cake!
Gee, how dare anyone think about "challenging his license to practice law"....
This brings us to the irony of this situation. Back in 1990, Martin Lipske's law license was suspended in Wisconsin and Minnesota for nearly 4 years for exactly this type of behavior and then some. General lack of due diligence in his work as an attorney. Still today he repeatedly fails to complete simple tasks of fulfilling open records requests and returning a completed Pre-Parole Hearing form to the DOC.
To make matters worse, it is clear from this letter that DA Lipske is taking the 17 years of error, malicious prosecution & corrupt practices he is responsible for which directly contributed to the wrongful conviction of Donald Miller, well, rather personally...
If that alone is not a testament to his unfitness as a District Attorney I don't know what is.
